In Orange County, New Jersey, the family of a 62 year old woman recently obtained a $1,350,000 settlement following her death. According to reports, the woman died after she had an allergic reaction to hypertension medication that had been administered by her cardiologist.
After her death, the family worked with malpractice attorneys, Cerussi & Gunn, PC, to file their medical malpractice lawsuit. The firm represented the woman's entire family, along with her oldest daughter who had been present at the time of the woman's tragic death.
The lawyers representing the family claim that the doctor who had given the woman the medication had been treating her for over 10 years. Despite having a standing patient-doctor history with the woman, the doctor managed to overlook the woman's medical records, which had notes about the woman's allergies to hypertension medications and that the woman was known to have sulfa drug allergies.
Right before her death, the woman had visited her doctor because she was suffering from a terrible migraine. The physician claimed that the migraine stemmed from her hypertension and then prescribed her with the medication that eventually killed her.
It is reported that the woman took a sample pill after seeing her doctor and she immediately became ill and started experiences adverse side effects like nausea, dizziness and fatigue. The woman told her daughter about her symptoms and the daughter called the pharmacy where the prescription was filled. That is when the daughter learned that he mother was suffering from an allergic reaction. An ambulance was called and the woman was taken to a nearby hospital where she passed after fluid had filled her lungs.
The family sued the doctor for
medical malpractice and also for emotional distress. The family and their lawyers were able to settle the lawsuit out of court for $1.35 million.
