A Los Angeles man has lost a $19 million medical malpractice lawsuit which accused a hospital and two doctors of malpractice after a surgical procedure left his infant son with brain damage. The case filed by Eduardo Rivas was a matter of whether or not he had given consent to the 2007 surgery. The hospital could not provide a record of the man giving consent. The hospital was able to argue that the child's problems were primarily the result of being born four months prematurely.
