A former Ohio University student who needed an arm amputation as a result of a misdiagnosed rare flesh eating bacteria disease now are reportedly asking the Franklin County Court to take over jurisdiction. According to reports, the student and her family initially sued the University for damages in the Franklin County Common Pleas Court. However, the Judge reportedly granted a motion by the University to dismiss the case on the grounds that state law mandates a cap on damages sought from a state University. It is reported that the victim’s family is suing not only because of the alleged misdiagnosis but also because the University reportedly maintained that it could provide healthcare that was equivalent to private hospitals and clinics.
