Court Dismisses Malpractice Claim

A court has dismissed a medical malpractice claim against a VA clinic in the Tennessee area. According to reports, about 10,000 veterans were notified a few years ago that they may have been exposed to hepatitis B, hepatitis C and HIV while undergoing colonoscopies at the facilities. The exposure risk was reportedly due to the improper cleaning of the tools used to perform the procedures. However, some cases are being dismissed as the court is ruling that patients have filed too late. There is a law that the claim must be filed within three years of the negligence, however patients didn’t find out about the negligence until 2009.
