J&J Metal Hip Implant Lawsuits

As human beings we are fragile, and over time even the strongest of bodies will betray their owners and incur injuries and illnesses. Johnson & Johnson is known as one of the world's top sellers in the medical field and health care products, and it is rumored that they stopped sales in the United Kingdom after information was released about at least 12% of their products failing within the first five years of usage. One lawyer representing a victim of the specific hip implant, the ASR XL, claims that the damages that this defective product have done to so many patients was far beyond what a doctor or other medical professional could have foreseen, and the fault rests entirely with J&J for withholding such vital information from the public.

The main concern with the metal on metal hip implant is the fact that the metal cup and metal ball rub against one another and cause shards of metal to be worn away eventually damaging and killing the soft tissues surrounding their hip joints. Not only is it damaging the tissues, but these metal scraps are also being released into the blood stream of the patients in unsafe amounts, causing concerns with infections, joint dislocations, and fractures as a result. It is believed that at the end of the many lawsuits, J&J could result in paying billions of dollars in damages and litigation for their defective product. Johnson & Johnson is not the only company being held responsible for this product and cover up, DePuy Orthopedics is also being included in the lawsuits for specifically failing to warn the public about the defects as well as their negligent recall and defective product design. Reports claim that DePuy is seeking to not be held responsible for the defective product, claiming that they acted accordingly regarding the faulty product, whereas J&J did not.

Out of an initial round of trials including 10,000 lawsuits from victims, J&J is seeking to settle $200,000 per case, resulting in billions of dollars if the victims agree to the terms. At this point lawyers on the cases share that the clients have thus rejected the offer for the $200,000 and are seeking substantially more in compensation for their suffering.
