The federal government recently discovered that a St. Louis County doctor bought misbranded and unapproved drugs for chemotherapy from overseas and used them on his patients. A federal indictment that was recently unsealed revealed that the doctor bought over $300,000 worth of drugs from two residents of California. The Californians had bought the drugs from a packager in the United Kingdom who purchased the drugs from manufacturers in Sierre Leone, Turkey and other countries.
The major problem with these drugs is that they are marked with unapproved labels with text in other languages, and they carry no information about dosage or potency. The facilities that these drugs were manufactured in did not receive proper certification from the U.S. Food and Drug Administration, and they were shipped in packages to conceal their contents. There is no substantial proof showing that the drugs were stored or shipped improperly.
Unapproved Drugs & Medical Malpractice Claims
The doctor was indicted last month on a charge of introducing prescription drugs into interstate commerce, a misdemeanor offense to which he plead guilty. He had not been subject to any public disciplinary actions, and has not lost any medical malpractice cases in the last five years. It is not yet clear what effect the unapproved drugs have had on his chemotherapy patients, but time will tell.
If the drugs are found to cause harm to any of the doctor’s patients, it is likely that a medical malpractice claim will be filed against him. The laws and regulations for medical malpractice claims differ from state to state according to the jurisdiction of the state, and it is wise to enlist the help of an experienced St. Louis injury attorney before proceeding with a claim.
